M Host LLC (hereafter referred to as “Host) provides management services for the Property and hospitality/concierge services for the guest (collectively, the “Services”). Host is committed to providing each guest with a memorable VIP vacation experience and to ensuring that each of the properties we manage provides a consistent level of cleanliness, cozy linens, and a well-stocked kitchen with special dish and glassware. Host can also stock your refrigerator before you arrive, provide daily maid service, book reservations and help to plan your vacation. Experience our VIP treatment!
By using the Services, you agree to comply with and be legally bound by the terms and conditions of this Short-Term Rental Agreement (hereafter referred to as “Agreement” or “Lease”). These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and Host.
IMPORTANT: By signing or clicking “Book Now,” you are acknowledging and agreeing to the following terms and conditions of this Agreement.
Key Terms used in our Terms of Service “Accommodation” or “Listing” or “Property” or “Premises” or “Home” means a residential home, condominium, cabin or other dwelling that is booked via the Services.
“Booking” means the act of reserving a Property and completing the full payment process.
“Check In Date” is the start date your booking shows for your vacation.
“CHECK-IN TIME” is 3 pm CST “CHECK-OUT TIME” 10am CST. Due to cleaning schedules, we are not able to offer early check-in or late check-out. If you need an early check-in or late check-out, we offer an additional add-on night for $300, when available. Please request the additional add-on night as early as possible for increased availability
“Guest” or “Guests” or “Tenant” means the person or persons requesting a booking of an Accommodation or stays at an Accommodation (and is not the Homeowner for such Accommodation).
“Homeowner” or “Owner” means a person or group that owns or controls the Accommodation.
HOUSE RULES: All Guests agree to abide by the reasonable requests of the Owners including but not limited to the house rules. No commercial activities are allowed on the premises at any time, and no signs, structures or banners shall be erected or displayed. Each listing may have specific rules regarding large groups, parties, pets, smoking, etc. These rules are detailed in the Property Description section of each online listing and are incorporated into this short-term rental agreement. Please review these terms carefully, as violation may result in additional fees or eviction without refund. You will also find house rules in each home.
MAXIMUM OCCUPANCY: Only the maximum number of people specifically registered at the time of booking and final payment shall occupy the premises as overnight Guests. Children are counted in total occupancy regardless of age. Over-occupancy is a material violation of your agreement and may cause an expedited eviction, forfeiture of all sums and additional charges of $100/pp/per day. Daytime visitors, other than guests, are allowed without any additional charge. Maximum number of daytime visitors are restricted to 6. If you have additional overnight guests, please contact us and we can easily adjust your contract. Daytime visitors must leave the premises no later than 12:00AM. Daytime visitors that remain on premises after 12:00AM will be considered additional overnight guests. Visitors shall never be allowed on any property without Guests present. Guests are 100% responsible for any damage caused by visitors. When booking, rental fees are based on guest count. Rental fees increase for guest counts exceeding 6 guests. Be sure to enter the correct number of guests when booking, as the rental amount is based on guest count entered. If additional guests, exceeding 6 guests, need to be added after the initial booking, additional fees will be charged. Additional guests exceeding 6 guests are $45/ person per night. Guest will be charged for any undisclosed guests, including day guests at a rate of $100/ person per day. Guests must adhere to a maximum number of ten (10) guests occupying this unit unless specifically agreed upon, in writing, prior to check-in.
HOUSEHOLD SUPPLIES: Owners will provide a supply of liquid hand soap in each bathroom and kitchen, dishwashing detergent and laundry detergent. Properties will have an initial supply of paper towels (2 rolls), toilet paper (3 rolls in each bathroom) and enough garbage bags to use 1 bag for each day of stay. If you feel you may need more, please add these to your supply list. Additionally, a variety of spices and cooking ingredients are generally available for Guest’s use. Kitchen appliances and cooking tools will be noted in each Listing. Please contact us should you have any specific needs and we will confirm if available. Clean linens for each bed and bath towels (1 large bath towel for each Guest and 3 hand towels for each bathroom will be provided). Additional supplies may be purchased for in-stay delivery at our online marketplace. Popular items include firewood and extra popcorn.
NOT INCLUDED: Not included in this lease is daily maid service, household supplies, baggage handling, pay per view charges, auto rental, food, liquor, laundry, personal items, excessive wear and tear, or excessive cleaning upon departure (i.e. stained or soiled cushions, upholstery, carpet shampooing, etc.).
CHILDREN: This home is NOT CHILD PROOF and requires young children to be properly supervised. Severe injury or death could result from failure to properly supervise children. Additionally, children are not to play on the decks or loft railings, stairways or any of the furnishings. There are breakable items. There are NO locks on cabinets which may include items that can harm a child such as cleaning materials, chemicals, plastics, or pots and pans. In addition, the decking cables on our patios are not intended to hold the weight of child. Any climbing on the railings could result in serious injury. Any party traveling with children takes responsibility for the safety and well-being of their entire party, including children. TENANT alone is responsible for child safety.
NOTE: weight limit on top bunks and trundle is 200 pounds.
HOUSE PARTIES OR EVENTS: There shall not be any “house parties” or “Events” on the Premises. Celebrations (birthday, anniversary or similar) are allowed as long as occupancy rules are followed.
DISTURBANCES: Guest acknowledges that each property is part of a quiet peaceful community and will be highly considerate of the neighbors. The premises shall not be used in such a manner as to generate noise (including loud music) which will disturb neighbors, nor will neighbors be harassed or bothered in any manner. Guest understands that many homes do not have fencing and that Guests agree to not cross through neighbor yards. Absolute quiet time begins at 10:00 PM until 7:00 AM daily. Tenant agrees to pay any fines associated with disturbance of the neighbors as imposed by the authorities.
NO SMOKING: Smoking is strictly prohibited anywhere in this home and is grounds for immediate eviction. Additional cleaning fees will be assessed if this rule is violated. Ashtrays are provided on the deck for outdoor use only.
VEHICLES: No more vehicles than can be safely parked in the driveway area shall be allowed at any time. Parking is prohibited on the main street. Tenant is solely responsible for their own vehicles always. Parking is allowed in the circle drive in front of our home, and never on the grass. We have a very expensive septic system installed in most of the grassy areas. Parking on the grassy areas may crush our septic system. Tenants and their guests are responsible for any damages caused by parking or driving on the grass. Please be mindful of neighbors and do not park in front of neighbors’ houses or block the driveway adjacent to our home, which belongs to the neighbor in the little pink house next door. Additional parking for boat trailer etc. is in grassy lot across the street where our dumpster sits. Please do not block dumpster on Tuesday pickup days.
OWNER’S CLOSETS: It is expressly agreed that the locked closets and designated area of the upstairs master closet are private and for the sole use of the owners. These are our extra supplies to be set out for the next guests. Please do not remove any items from this storage area as it may inhibit our ability to provide our next guest with the same hospitality as you received. These areas are not included in this lease. Items removed from these areas will require additional cleaning fees.
ALTERATIONS: No alterations shall be made to the premises, nor locks installed anywhere. WEAR & TEAR: Guest agrees to maintain the premises in the same condition as when received and will not allow any damage, waste, misuse or neglect. Should any damage, waste, misuse or neglect occur on the property, it will be the sole responsibility of the Guest and Guest agrees to promptly pay the reasonable costs thereof.
FURNISHINGS: Guest agrees not to move or alter any of the furnishings and shall use them only for the purposes intended. Guest shall respect and protect all furnishing and décor and understands that many of the furnishings are unique and valuable. Guest shall be solely responsible for the replacement value of any damaged or destroyed furnishings on the property.
MAINTENANCE – Host cares very much about the Property and strives to keep it in excellent shape. If you notice any problems or maintenance issues, please notify Host immediately.
GUEST’S PERSONAL PROPERTY: Guest’s personal property and effects are the sole responsibility of the Guest throughout the tenancy. Owner’s insurance will not cover tenants’ personal property and Owner will not be liable for any loss or damage due to theft, or loss of such personal property arising from any acts or negligence of any other person, or from any cause whatsoever, nor shall the Owner be liable for any injury to the Guest or other person in or about the premises.
INSURANCE – TRAVEL DISRUPTION: Guest agrees that Owners shall not be liable for travel disruptions caused by any reason, including inclement weather, Tenant’s personal property or illness or injury. Tenant is strongly encouraged to purchase a travel insurance policy.
MANAGEMENT OR OWNER ACCESS – If requested, you shall allow Host or Owner access to the property during your stay. Your Host shall exercise this right of access in a reasonable manner.
ASSIGNMENT: This Agreement may not be assigned, or any portion of the premises sublet. Any attempt to do so shall be considered a material breach of this contract.
CHANGES: The parties hereto further agree that any changes to this agreement are to be in writing to be enforceable or otherwise are null and void.
FAX/ELECTRONIC: Copies and signatures by facsimile or electronics are considered valid. The parties shall retain the originals for verification. Host retains all Booking data.
PETS: Pets are NOT allowed at this property. Additional cleaning fees of $200 per pet will be charged for any undisclosed pets that are brought onto the property. In addition, guests will be charged for replacing all items, such as rugs, pillows, etc. that are stained or damaged.
DAMAGE CLAUSE: This vacation home’s inventory and condition is inspected and recorded prior to each guest arrival and again immediately following each guest departure. Guest will be charged for the repair or replacement of any damaged items, or items that have been removed and not returned to this vacation home. Guest will be charged for accidental or unintentional damages/ theft. Guests using glitter will be charged $75 for glitter removal.
CAMERAS, VIDEO AND AUDIO RECORDING: For security purposes, the exterior is monitored by two cameras. Two cameras in the front record video & audio of front yard, door and driveway. The cameras record video and audio and provide us the ability to communicate verbally in case there is any issue at check in. There are no interior cameras or cameras in private gathering areas outside. Guests are not allowed to tamper with, unplug or cover the exterior cameras or CO2/smoke detectors.
DAILY OR MID-STAY CLEANING: The vacation home will be cleaned, sanitized and prepared for rental use before guests arrive and will be cleaned and sanitized after guests check out. Scheduled mid-stay or daily cleaning is available for an additional fee upon request.
EXTENSIVE CLEANING FEES: Our vacation home is inspected prior to each guest arrival and immediately upon departure. Should Lakeview Hideaway require extensive cleaning following your departure, additional cleaning fees will be charged to the Tenant.
TOWELS AND LINENS: Linens and bath towels for listed guests are included. We do not permit bath towels/linens to be taken from the unit. Please use make-up remover or provided black wash cloths for make-up removal and personal care. Also, colored towels are provided for use on messes, muddy feet/ paws, etc. Please use white bath towels only for bathing. Any stained linens that need to be replaced will be charged to the Tenant.
TENTS: Up to two tents are allowed in the backyard area behind the house or in the fenced area beside the house. No tents are allowed on the grassy lawn on the chimney side of the house. Guests will be charged for damages to grassy lawn on the chimney side of the house caused by setting up tents.
RATE CHANGES: Rates are subject to change without notice and will only be guaranteed upon processing of a signed rental agreement and receipt of payment. Rates will not change after a booking has been paid and confirmed.
FALSIFIED RESERVATION: Any reservation obtained under false pretense of another person’s identity will be subject to the forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in. Unauthorized party may be legally arrested and charged with trespassing.
INDEMNITY AND RELEASE: Guest agrees to indemnify and hold harmless Landlord, Property Managers, Owners, and any of their respective agents, representatives or employee from any loss, claim, liability, or expense arising from injury to any person (any tenant or guest, invitee, agents, or others under their control) or damage to or loss of any property.
GUEST LIABILITY: Guest assumes all liability for personal injury, property damage or loss to tenant or guest, invitee, or any persons in party.
USE OF PROPERTY: In the unlikely event of unforeseen circumstances on the part of the owner, which may preclude the guest from using this property, the guest will be notified. The guest will also have the option of a full refund in order to obtain their own alternative accommodations. Example of such circumstances would include an unplanned sale of the property, legal or maintenance issues. Natural Disasters would not be covered under this clause.
MINIMUM AGE REQUIREMENT: There will be no rentals to individuals 25 years of age or younger. The primary responsible Tenant must be older than 25 years.
SPECIAL TERMS: Guest agrees that; any problems or disagreements resulting from this rental or rental agreement will be settled by Arbitration. Guest will not engage in any form of legal action such as a Civil Law Suit. Guest agrees not to retain the services of any attorney-at-law or a law firm to settle any dispute. Guest agrees that any dispute will be resolved through Arbitration and never litigation.
PERSON OF CONTACT: M Host, LLC does not have a manager on-site at 413 South Lakewood Circle, Lake Bridgeport, TX. For assistance during your stay, contact M Host LLC by phone or email. We will respond to your inquiry within 24 hours. As a courtesy, we try to respond more quickly. If you have an emergency during your stay, call 911.
EVACUATION: In case the home is evacuated for any reason, including natural disaster, then guest will be refunded for the portion of their stay that was unused. Guest acknowledges and agrees:
1. Guest acknowledges that the Property is rugged – perched on a cliff overlooking the lake.
2. Guest is aware that staying at the Property involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, falling, sports injury, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Property during my stay, and the condition of the Property. Guest acknowledges that the description of the risks in this Release of Liability, Waiver of Claims and Assumption of Risk (the “Document”) is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury and or/death.
3. In consideration of being permitted to rent and stay at the Property, Guest agrees on Guest’s behalf, Guest’s family, any and all guests, and invitees that Guest is fully responsible for any and all risks of injury or death. Guest hereby releases and holds harmless M Host, LLC and its members, principals, agents, officers, employees, and representatives and the Owners of the Property (collectively “Releasees”).
4. Guest understands and acknowledges that being in or near the lake present various risks and hazards, including strong currents, unexpected wave activity, floating debris and other potential hazards. Guest assumes all such risks associated with being near or in the lake, including the obligation to notify all guests of such risks.
5. Guest agrees to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including bodily injury or property damage that may result from or be related in any way to Guest’s rental and stay at the Property. Guest further agrees to indemnify and defend Releasees, through their own choice of counsel, against any and all claims arising out of or related in any way to Guest’s rental of the property, including claims by third parties.
6. Guest agrees that any claims arising out of Guest’s rental and any claims of damage or injuries at the property will be determined by binding arbitration before a single arbitrator in Texas. Guest understands that Guest is waiving the right to a jury trial. I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE DOCUMENT AND THAT I UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM. I UNDERSTAND THAT THIS DOCUMENT APPLIES TO AND SHALL BE EFFECTIVE AND BINDING UPON ME, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE, ESTATE, AND ALL MEMBERS OF MY FAMILY, MINORS, INVITEES, AND OTHERS IN MY CARE, CUSTODY OR CONTROL, AND AGREE TO ADVISE ALL SUCH INDIVIDUALS OF THIS DOCUMENT AND CAREFULLY SUPERVISE THEIR USE OF PROPERTY.
